MHSI annual reports 

The Mine Health and Safety Inspectorate Annual Report is a document by the Chief Inspector of Mines. It contains information on health and safety at mines as well as the activities of the Mine Health and Safety Inspectorate, compiled as required by Section 49(I)(j) of the Mine Health and Safety Act, 1996 (Act 29 of 1996) as amended.

Guidelines and guidance notes

In accordance with Section 9(2) of the Mine Health and Safety Act, 1996 (Act 29 of 1996) as amended, the South African mining industry must prepare and implement Codes of Practice and guidance notes on any matter affecting the health or safety of employees and other persons who may be directly affected by the activities at the mines of South Africa. 

These guidelines or guidance notes complements the legislation. It establishes a minimum, acceptable work practice about a specific topic in the mining industry that the Chief Inspector of Mines wishes to control by means other than the regulations.

Occupational health and safety reports

The Mine Health and Safety Inspectorate prepares reports from occuational health and safety data and provides an analysis of the data presented in the reports for the specific time period.

Mine Health and Safety Act and Regulations 

The Leon Commission of Inquiry was mandated to investigate all aspects of the legal regulation of both health and safety in the South African mining industry. After consultations between Government, the employers and employee representatives, many recommendations were incorporated and as a result of this the Mine Health and Safety Act, 1996 (Act 29 of 1996) as amended was promulgated.

 Other legislation

Before the promulgation of the Mine Health and Safety Act in 1996, the safety of the South African mine workers was provided for in the Mines and Works Act, 1911 and 1956. The Mines and Works Act, 1956 was repealed by the Minerals Act, 1991. This act focused predominantly on mine safety with little or no emphasis on the occupational health status of the mine workers. 

The Minerals Act was then repealed by the Mineral and Petroleum Resources Development Act, 2002. The Mine Health and Safety Act was promulgated in 1996 following the outcomes of the Leon Commission of Inquiry. The Mine Health and Safety Inspectorate under the Chief Inspector of Mines administers this act and it is the primary legislation governing the health and safety of South African mine workers and communities affected by mining activities.
